High School Student struck by Driver
In September of 2021, around 4:30 pm on a beautiful Saturday afternoon our (then) 17-year-old client began her usual afternoon jog around the neighborhood. Before her injuries, she was a two-sport athlete at Upper Darby High School and physical fitness was a customary part of her daily life.
While she was jogging towards the intersection of Edmonds Avenue and Township Line Road in Drexel Hill, she paused her run to wait for the traffic signals to switch. Once the light changed, she resumed her jog through the intersection. At that moment, an ambulance traveling on Township Line Road suddenly rushed through the intersection at a high rate of speed while all other cars at the intersection remained at a standstill. As our client was entering the crosswalk and crossing Township Line Road, the defendant-driver, who was attempting to tail the ambulance at a high rate of speed, struck our client head-on. She was hit with such force that she was flung several dozen feet from the point of impact.
Thankfully her life was spared, but the violent crash caused serious injuries to our client. She sustained a traumatic brain injury, fractured pelvis, fractured sacrum, third degree burns from landing on the pavement and multiple facial lacerations. She later missed over five months of her senior year at Upper Darby high school.
With no time to lose, the team at Marciano Legal conducted aggressive discovery and quickly obtained surveillance video from a storefront near the intersection that clearly depicted the force of the impact and the defendant driver’s negligence – evidence that was never obtained by the police.
As a result of their quick response and evidence gathering, attorneys Kevin Marciano and Josh Tebay secured a six-figure settlement on behalf of the innocent injured victim prior to trial.
