Marciano Legal Secures Pre-Trial Settlement in Jobsite Injury Case with Thirteen Defendants

In Collegeville, Pennsylvania, a fifty-one-year-old man was working on a jobsite when he fell about 17 feet off a ladder to the concrete floor and suffered permanent and disabling injuries. As a result of his injuries, he was unable to return to any form of work. In addition to the significant pain and suffering that he endured during his injury and the pain and suffering and loss of life’s pleasures he has suffered ever since that day, the man also suffered major economic loss.

Kevin Marciano and Evan Sing pursued the thirteen potentially responsible entities through litigation. In the pleadings, Mr. Marciano and Mr. Sing stated that Defendants failed to recognize numerous unsafe routes of conductors, cabling and conduits placed directly behind the rungs of the fixed ladder in question. Those prohibited obstructions were installed by several parties over time. This unsafe installation of conductors, conduits and cables either went unnoticed or was ignored. Facility managers, owners, and general contractors must have effective health and safety programs with an emphasis on the prevention of accidents and protection of those who work on their property, visit, inspect and maintain the site. That includes providing safe site conditions, routine safety inspections, securing the buildings from unauthorized persons or trespassers, safe access for inspectors, emergency responders etc.

On the eve of trial, Mr. Marciano and Mr. Sing were able to obtain a favorable settlement for this injured worker.
