    Fall on Defective Sidewalk Commands Six Figure Settlement

    Attorneys Evan Sing and Kevin Marciano secured a six-figure pre-trial settlement in a trip-and-fall premises liability action where plaintiff, a 27-year-old employee at a Philadelphia café, tripped on a defective section of the sidewalk while transporting trash bins in the course of his employment.  The young man struck his face on a trash bin and suffered permanent injuries including loss of six permanent teeth and a mandibular alveolar bone fracture. 

    The owner of the property management company admitted at his deposition that “the sidewalk is clearly a problem.”  Further, regarding inspections, the property owner (who resides in another country) testified that he “thinks” the management company does them and that they “must go through the property from top to bottom.”  Yet, the president of the management company testified that other than when the sidewalk was replaced after this incident, there were no other prior times that his company inspected the sidewalk
