Marciano & MacAvoy Secures Product Liability Settlement for Worker Injured by Defective Trash Toters

In our product liability practice, we take on corporations that design, manufacture, and sell defective products that injure our clients. In 2023 we settled one of our client’s cases against a manufacturer of large trash cans, or toters. The toters are on wheels and have a bar on one side so that a mechanical lift on a trash truck can pick up the toter and empty it. Our client worked in waste management and operated the mechanical lift of a trash truck to hoist and empty toters into the truck. Twice in a span of three months, the handles broke off two separate toters manufactured by the same company. Each time, the handles struck our client in the face causing him serious injuries. Our client lost four teeth in the first incident and a broken nose in the second incident. His injuries left him with permanent facial scarring. As a result of his injuries, our client was out of work for approximately two months. After a lengthy litigation process, we obtained a favorable settlement for our client from the manufacturer of the toters.
