Fixing your roof? You probably need a ladder. Changing a lightbulb? You may need one, too. Cleaning fall leaves out of your gutter? You’ll most likely need a ladder for that as well.
Needless to say, almost every home has a ladder for one purpose or another. Some jobs, such as those in construction, actually require their use on a daily basis. Unfortunately, ladder accidents and resulting injuries are far too common on these tools, with many being a result of defective products.
Defective Ladders
Werner, based in Greenville, Pennsylvania, is one of the world’s largest ladder manufacturing companies, also producing step stools, scaffolding, and fire escapes in the U.S. Their popular products are a household tool for many across the country.
However, the company has been hit with multiple product liability lawsuits in recent years. Many homeowners claimed that Werner’s designs and manufacturing for its products were inadequate and caused injuries due to defective hinges and other parts. A class-action case was also brought against the company in 2013 after it was alleged that the company failed to recall its Steel Easy Access Attic Ladder, which caused serious injuries, including:
- Head injury
- Neck and back injury
- Spinal cord injury
- Broken bones
- Concussion
Most recently in June 2018, Werner recalled its Multi-Purpose Telescoping Aluminum Ladders, claiming that “the ladders can break while in use, posing a fall hazard to the user.” This came after reports of injuries by consumers, one which resulted in an injury to the left side and the elbow of a consumer.
If ladder accident injuries are not fatal, they can still result in high medical bills, lost wages, and pain and suffering. When this occurs due to defective products, the manufacturing company should be held liable for allowing these products to be put on the market.
