Marciano & MacAvoy, P.C. Secures Medical Malpractice Settlement for Patient Suffering from Wernicke’s Encephalopathy After Bariatric Surgery

Marciano & MacAvoy, P.C. is proud to announce we recently secured a favorable medical malpractice settlement on behalf of our client, a nurse, wife and mother of 3. Our client was hospitalized for several months after undergoing gastric bypass surgery. Despite apparent warning signs and symptoms, doctors and other medical staff at the hospital failed to diagnose and treat a thiamine, or vitamin B1, deficiency in a timely manner. This caused devastating permanent nerve and brain damage which left our client with impaired vision and speech, ataxia, and unable to walk independently. The deficiency also resulted in our client now having Wernicke’s Encephalopathy.

It took years of relentless litigation and on the 4th day of the courtroom trial, the defendant medical providers finally paid our client what she deserves. This successful result will go a long way in helping her in the everyday activities we all take for granted, and we could not be prouder of our client for the courage and strength she showed in testifying before the jury.

Unfortunately, our client is not alone in her painful journey. Research shows there has been a worrying increase in the number of malpractice claims related to Wernicke’s Encephalopathy following bariatric surgery. To learn more about this growing epidemic and how it may affect you, click here.
